Kisakye wants file Owiny-Dollo confiscated during the presidential election petition returned and read out to the public
Justice Kisaakye also wants to be refunded for the cost of buying a pair of reading glasses and the expenses incurred for eye surgery in the United States of America.
The bad blood between Dr. Esther Kitimbo Kisaakye, a Justice of the Supreme Court of Uganda, and Alfonse Chigamoy Owiny-Dollo, the Chief Justice of Uganda, continues to boil and will soon reach a tipping point.
In her pursuit of justice, Justice Kisaakye as petitioner has filed a petition dated 22 September 2022 to the Constitutional Court, against Justice Owiny-Dollo. In this petition, Justice Owiny-Dollo will be the first respondent.
Others are Dr. Pius Bigirimana, the Permanent Secretary to the Judiciary, Apophia Tumwine, the Commissioner of Human Resources of Judiciary of Uganda, Sarah Langa Siu, the Chief Registrar in the Courts of Judicature of Uganda, the Judicial Service Commission and the Attorney General.
In the petition, Justice Kisakye wants the court to order that her file containing her ruling arising out of the Presidential Election Petition No. of 2021 (Kyagulanyi Ssentamu Robert vs Yoweri Museveni Tibuhaburwa, Electoral Commission & Attorney General) that was confiscated by Justice Owiny-Dollo be immediately returned to her. She also wants the court to allow her to deliver her full rulings in the said case.
In March 2021, a scuffle ensued at the Supreme Court during the reading of the ruling arising from the Presidential Election Petition No. of 2021 when Justice Owiny-Dollo forcefully used police officers who confiscated Justice Kisaakye’s file containing her ruling. A video of the scuffle baffled Ugandans and independence of what Justice Owiny-Dollo was delivering in his ruling.
And now, Justice Kisaakye wants her file back and also wants its content known publically. She also wants the court to pronounce that Justice Owiny-Dollo acted illegally.
She also wants a permanent injunction barring Justice Owiny-Dollo, his agents or servants from ever directing, ordering or closing the Supreme Court premises to prevent a Justice from delivering a ruling or locking out litigants, the media or other court users.
